Terms of Service
These terms govern use of Matcha's website, event management tools, event pages, personal galleries, shared albums, live albums, and related services.
1. Accepting these terms
By using the Matcha website or services, you confirm that you have read and agree to these terms. If you do not agree, do not use the service.
Matcha may update these terms from time to time. The current version will be published on the site, and continued use after publication will be treated as acceptance of the updated terms where permitted by law.
2. The service
Matcha provides digital tools for event photo experiences. The service may include event pages, photo uploads, shared albums, live albums, personal guest galleries, face matching, sharing links, and related event-management tools.
The service is intended for hosts, producers, photographers, event managers, and guests who receive access to an event page or personal gallery.
3. Customer responsibilities
A customer who creates an event or uploads content is responsible for having all rights, permissions, and consents needed to use event photos, guest details, and other information provided to Matcha.
- Do not upload content that infringes privacy, copyright, reputation, or another person's rights.
- Do not use the service to distribute unlawful, harmful, misleading, or unauthorized content.
- For events involving minors, make sure photos and information are used with the permissions required by applicable law.
- Inform guests about use of the service and handling of their information where appropriate.
4. Guest use
Guests may receive access to an event page, upload photos, submit a selfie for photo matching, view a personal gallery, or download photos, according to the event settings.
A personal gallery or private link is for its intended recipient. Do not attempt to bypass access controls, access information not intended for you, or use a link in a way that may harm others.
5. Content, ownership, and license
Ownership of uploaded photos and content remains with the relevant rights holder. Uploading content grants Matcha a limited license to store, process, create previews, match, display, and make the content available only as needed to provide the service and according to the event settings.
Matcha does not acquire ownership of event photos and will not use them for external marketing without appropriate permission.
6. Face matching
Some services use a selfie or other identification image to help a guest find photos in which they appear at a particular event. Results can be affected by image quality, lighting, angle, face coverings, photo volume, and other factors. Matcha does not guarantee complete, accurate, or error-free matching.
7. Shared and live albums
Where a shared or live album is enabled, guests may be able to upload photos. When event settings include moderation, uploads are not shown to others until approved. Matcha and the event organizer may reasonably remove or hide content for privacy, rights, safety, or service reasons.
Anyone uploading content is responsible for having the necessary rights and permissions. Do not upload unlawful, harmful, misleading, or privacy-invasive content.
8. Payments, cancellations, and refunds
Payment, cancellation, refund, postponement, and event-change terms are set out in the offer, order, or commercial agreement provided before a customer purchases the service. If no specific terms apply, a request will be assessed based on the preparation already completed, the event date, work already performed, and applicable law.
Where guest payment or paid access is offered, the payment process and sale terms are subject to the service settings and the commercial arrangements for that event.
9. Service period and photo retention
Event-photo retention begins on the event date. Matcha Album and Matcha Match media are retained for three months, and Matcha Experience media is retained for six months, unless a different period is stated in the offer or order. At the end of that period, a gallery or parts of it may become unavailable or be deleted.
10. Availability
Matcha works to provide a stable and accessible service but does not guarantee uninterrupted, error-free, or delay-free availability. Interruptions may arise from maintenance, demand, communications failures, third-party providers, or circumstances beyond Matcha's control.
11. Limitation of liability
The service is provided as available. To the extent permitted by law, Matcha is not liable for indirect loss, lost profits, lost data, reputational harm, or harm caused by unauthorized use of content uploaded by a customer or someone acting on their behalf. Nothing in these terms limits liability that cannot lawfully be limited.
